Family Law Dispute Resolution Solicitors in Perthshire, Tayside, Stirlingshire & Beyond

If you are in the unfortunate position where your marriage, civil partnership or relationship has broken down, we advise that you seek legal advice from an accredited Expert Family Law Dispute Resolution Lawyer as soon as possible.

In addition to the obvious personal distress when a marriage or civil partnership breaks down, there are practical issues to be resolved. The earlier you seek advice, the more likely the best solution can be found, often reducing the opportunity for complications and a breakdown in communication along the way.

The legal practicalities of Divorce and Separation can be addressed through a range of methods including Collaborative Family Law, Negotiation, Litigation, Mediation or Arbitration. Our expert Dispute Resolution Lawyers will help you choose the process that is best for you and guide you throughout.  What matters to us, matters to you. At Macnabs, we go the extra mile to find the legal solution that will best suit your needs and help you get on with your life, post-separation.

Collaborative law
Parties must both instruct solicitors who have undergone collaborative law training. Parties and their solicitors agree that court proceedings will not be raised and commit to full disclosure and a ‘solution seeking’ approach.

Ruth Croman is qualified to undertake collaborative law. More information on collaborative law can be found here.

Negotiation
This allows parties to determine for themselves, with the help of their solicitors, the best solution. The process involves an exchange of information with a view to finding terms acceptable to both parties.

Litigation
When parties cannot reach agreement themselves or with the help of their solicitors, they can ask the court to decide matters. This is likely to be the most expensive method but in some cases, it is the only option.

Mediation
This is a voluntary process where the parties, with the assistance of a neutral mediator, try to reach agreement. It is a less formal process than court and is also generally quicker and less expensive.

Arbitration
This allows for assembling relevant information and exploring possibilities in an investigative way. The process is managed by an arbiter who then makes a decision.
