Rental price cap – update for landlords

Private landlords are facing challenging times, particularly with the recent news of the rental price cap remaining in force until next March. These measures can add to the complexities of managing rental properties and impact landlords' ability to adjust rental prices according to market conditions.

The legislation, which was originally introduced to protect tenants and ensure fair treatment in the rental market, has been extended until 31 March 2024. One of the key provisions of the Act is the cap on most rent increases, which has been set at 3%. This measure aims to prevent excessive rental hikes, providing stability and affordability for tenants. By extending this cap, the Scottish Government continues to prioritise the well-being of tenants and their ability to manage their cost of living.

Furthermore, the extension also includes a delay of 6 months on the enforcement of most eviction orders granted by the tribunal. Again this additional time provides tenants with a temporary reprieve and allows them to seek alternative housing arrangements or resolve any issues that may have led to the eviction order. There are however exceptions to this and it is still possible to apply for and obtain an eviction order in the meantime, as only enforcement is affected. There are also important exceptions to the eviction ban if a landlord can demonstrate financial hardship.
