There are four main stages in the administration of an estate where no inheritance tax is payable: Obtaining information – all the assets and belongings of the deceased, including any debts, require to be investigated and valuations obtained where applicable. Preparation of the inventory of all assets for the executor’s approval prior to submission to the Sheriff Court to obtain Confirmation (known as Probate in England). Ingathering assets, closing accounts, cashing in policies and paying debts Distribution of the assets to the beneficiaries including organising for any sale or transfer of property If there is no Will, an executor (normally a family member) requires to be appointed through the Sheriff Court and we will be able to assist you with this. Where there is Inheritance Tax payable, our staff will deal with all the necessary paperwork for submission to HMRC on the executor’s behalf. WILL AID  – Help yourself and charity Remember, Remember, Will Aid November! What is Will Aid?November is Will Aid month and we are delighted to be taking part once again. Last year our team, with tremendous support from our clients as always, raised over £10 000. Will Aid offers a simple way to make your Will whilst supporting worthwhile charities. How does it work?How Will Aid works is quite simple – you make an appointment, we make your Will and instead of charging a fee you make a donation to the Will Aid charity. To try to make it as simple as possible for you to see one of our solicitors we are holding dedicated Will Aid appointment days in our Pitlochry, Blairgowrie and Perth Offices. In our Pitlochry Office these will be available on Mondays and Tuesdays. In our Blairgowrie Office, on Tuesdays and Thursdays, and in our Perth Office, Monday to Friday. A properly drawn up, legally binding Will ensures your assets are dealt with after your death in the way that you would choose and minimises anxiety and expense for your loved ones. It also reduces the likelihood of family disputes. Most people know the benefits of having a properly drafted Will in place, however, many of us do not get round to doing it or forget to keep it up to date as our circumstances change. If you do not have a valid Will, you are not in control of who inherits your hard earned assets. You cannot assume that any spouse, life partner or children will inherit everything.  If you die without a Will then the law will determine who will inherit from you and this may not be what you want to happen. In addition, there are also costly and time-consuming extra formalities required in administering your estate after you die if you do not have a valid Will.  For a Will to be legally valid, certain formalities have to be observed.
