Although Santa may be a resident of the North Pole, when he flies over Scotland, he is subject to the laws of our land. In Scotland, legally there is a presumption against gift. In simplistic terms that means that in the absence of any evidence to the contrary, if you can prove you provided someone with an item, then the assumption is it was a loan and not a gift. Meaning Santa – the person who provided the item – can then legally demand it back. If you can’t give it back (e.g. you’ve eaten the entire Ferrero Rocher chocolate mountain!), you could be forced to pay the giver compensation.

Macnabs has recently recruited a new trainee to take the total current trainee intake to four. Megan Carling joined the Family team at Macnabs after graduating from Aberdeen University with a law degree and completing her diploma at Strathclyde University. She joins trainees Aimee Young who worked for the firm as a Legal Secretary prior to undertaking her traineeship, as well as Lauren McIntosh and Vikki Carver who both assigned their traineeship to Macnabs from another local firm earlier this year.

Due to the planned staged retirement of our senior partner, we are looking to recruit a solicitor with significant family law experience. The candidate should ideally have 10 years+ PQE and be either an accredited family law specialist or have sufficient experience to apply for that status. Candidates should also be able to demonstrate high levels of technical ability, excellent client relationship skills and have a proven track record of handling family law cases to a good standard. The position will involve managing a substantial case load, daily client contact and regular sheriff court advocacy. Experience in conducting Court of Session litigation would be preferred but is not essential.
